We’re reaching out regarding the U.S. Department of Justice’s Title II Americans with Disabilities Act (ADA) Digital Accessibility Rule and the recent compliance updates that affect state and local governments.
What Changed?
In April 2024, the DOJ published its final rule requiring state and local governments to ensure their websites, mobile applications, and digital content comply with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. The rule was adopted under Title II of the Americans with Disabilities Act (28 CFR Part 35) and aligns with Section 504 and Section 508 accessibility requirements.
To provide agencies with additional time to prepare, the DOJ issued an Interim Final Rule on April 20, 2026, extending the compliance deadlines:
- Jurisdictions serving 50,000 or more residents: Compliance deadline extended from April 24, 2026, to April 26, 2027
- Jurisdictions serving fewer than 50,000 residents and special district governments: Compliance deadline extended to April 26, 2028
While the extension provides additional time, it should not be viewed as a reason to delay. Achieving compliance involves much more than running an automated scan—it requires manual accessibility testing, remediation, user validation, staff training, policy development, and ongoing monitoring. For many organizations, this process takes months to complete.
Failure to comply can increase the risk of:
- DOJ enforcement actions
- ADA litigation and complaints
- Exclusion of people with disabilities from essential government services
- Damage to public trust and community confidence
